1. Print this page.
2. Fill out the order form, read the Copyright Waiver and Limitation of Liability statement and sign the order form.
3. Send order form, along with videotape, to: The Digital Depot 24250 English Rose Pl. Valencia, CA 91354 (888) 595-5590 Please submit only one videotape and one order form per order.
Digital Depot COPYRIGHT WAIVER
By signing the Digital Depot order form, I represent and warrant that:
(a) I have the right to permit Digital Depot to perform the Digital Depot services on the videotape content I have submitted (“Content”), as contemplated by my order, including the copying and converting process,
(b) the Content does not injure, infringe, or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, or violate any obscenity law or other applicable law, rule or regulation in any jurisdiction in which the Content may be viewed or retrieved,
(c) Digital Depot’s provision of the processing and/or hosting of the Content hereunder will not infringe upon or violate any patent, copyright, trade secret, trademark or other intellectual property right of any third party, including but not limited to any and all performance license rights, mechanical license rights, synchronization license rights and rights under the Digital Performance Right in Sound Recordings Act of 1995, or violate any obscenity law or other applicable law, rule, or regulation in any jurisdiction in which the Content can be viewed, retrieved, and
(d) the Content and Digital Depot’s provision of the processing service on my behalf is not for any illegal, obscene, offensive, or immoral purpose.
LIMITATION OF LIABILITY
By submitting material to Digital Depot, customer requests processing services described, and agrees to pay any standard charges therefore. Customer agrees that the liability of Digital Depot, its agents and employees, for any losses or damages of any kind or nature to the customer's film or tape, or other material, is limited to the cost of replacing such tape with blank tape. Customer also agrees that Digital Depot, its agents and employees, shall not be otherwise liable to the customer for any loss or damage of any kind or nature, whether direct, incidental, consequential, or otherwise. Customer declares that all materials submitted to Digital Depot for transfer or other reproduction, are not in violation of any copyright laws. Customer will indemnify and hold Digital Depot harmless in respect to any claim of violation of such laws. The materials submitted were either created by customer or customer has the permission of the copyright owner to duplicate them. All copyrighted material must be accompanied with a written release form. Customer understands unclear or incomplete Chapter selections will be determined by Digital Depot Staff. Customer understands that DVD-R, the standard that Digital Depot uses,is not compatible with all DVD players. (See Compatibility List) If you have any questions, by email at info@digital-depot.com.
